1. Agreement to These Terms

These Terms of Service are a binding legal agreement between you and AK Dash regarding your access to and use of the AK Dash website, application, online platform, software, tools, integrations, communications, AI features, telephony features, and related services.

By accessing or using AK Dash, creating an account, or subscribing to the service, you agree to these Terms. If you use AK Dash on behalf of an entity, you represent that you have authority to bind that entity.

2. The AK Dash Service

AK Dash provides a proprietary online platform for service businesses, including sales, marketing, customer management, operations, scheduling, proposal, task, workflow, invoicing, reporting, telephony, AI, and related business tools.

3. Eligibility and Account Registration

You must be legally capable of entering into a binding agreement and provide accurate information. You are responsible for maintaining the confidentiality of account credentials and for all activity occurring under your account.

4. License and Access Rights

AK Dash grants you a limited, non-exclusive, non-transferable, revocable right to use the service for your internal business purposes. You may not sell, resell, or commercially exploit the service without authorization.

5. Subscriptions, Fees, and Billing

Certain features require payment of fees. Fees are generally non-refundable. Monthly billing may be based on subscriptions active at the beginning of the period.

6. Price Changes

AK Dash may change service pricing with at least thirty days' advance notice.

7. Term and Cancellation

These Terms continue while you maintain an account. You may cancel at any time, but cancellation does not entitle you to a refund for remaining subscription periods.

8. Suspension and Termination

AK Dash may suspend or terminate access for violations of these Terms, failure to pay fees, or security risks.

9. Customer Data

You retain ownership of your Customer Data. You grant AK Dash a license to host and process this data as necessary to provide the service.

10. Customer Responsibilities

You are solely responsible for how you use the service and for ensuring compliance with applicable laws, regulations, and third-party rights.

11. Laws, Privacy, and Electronic Communications Compliance

You must comply with all applicable privacy, data protection, and anti-spam laws, including TCPA and CASL where applicable.

12. Email and Messaging Rules

You must not use non-permission-based email lists, send unsolicited commercial email, or fail to include required opt-out mechanisms.

13. Telephony and Call Recording

If you use telephony features, you are responsible for complying with all recording and consent laws.

14. AI Services

AI features are provided "as is". Outputs may be incomplete or inaccurate, and users are responsible for validating AI-generated content.

15. Third-Party Services and Integrations

AK Dash integrates with third-party services like Google Maps. Your use of these is subject to their own terms and privacy policies.

16. Ownership and Intellectual Property

AK Dash owns all rights to the service. No rights are transferred to you except for the limited access rights granted in these Terms.

20. Warranties and Disclaimers

The service is provided "as is" and "as available". AK Dash disclaims all warranties, including merchantability and fitness for a particular purpose.

21. Limitation of Liability

To the fullest extent permitted by law, AK Dash's liability is limited to the amount paid by you during the period giving rise to the claim.

22. Indemnity

You agree to indemnify AK Dash against third-party claims arising from your misuse of the service or violation of these Terms.

24. Dispute Resolution and Arbitration

These Terms are governed by the laws of Anguilla. Disputes will be resolved by binding arbitration.
